A series of Supreme Court decisions say that making race the predominant factor in drawing voting districts violates the Constitution. On Thursday, the Supreme Court gathered to consider whether Donald Trump, as president, enjoyed immunity from prosecution for attempting to overturn the 2020 election. Even if the justices eventually rule against him, liberals should not celebrate the Constitution as our best bulwark against Mr. Trump. Each of these efforts has been motivated by a worthy desire to hold Mr. Trump accountable for his actions. It is not just that Mr. Trump would never have been president without the Electoral College. Think about why those previous efforts to use the Constitution to hold Mr. Trump accountable failed.

A Manhattan judge refused on Thursday to dismiss bribery and other charges against Senator Robert Menendez of New Jersey on the grounds that they violate constitutional protections afforded to members of Congress. The ruling does not address other grounds that Mr. Menendez, a Democrat, has cited in asking that the charges against him, which are still pending before the judge, be dismissed. Mr. Menendez could file an appeal of the ruling, which could end up delaying his trial for months. It currently is scheduled to begin on May 6. Lawyers for Mr. Menendez had asked the judge, Sidney H. Washington CNN —The Supreme Court said Friday that the United States Military Academy at West Point can continue considering race as a factor in its admissions process while a legal challenge to the practice plays out. Last week, SFFA asked the high court to step in on an emergency basis to block West Point from considering race in its admissions process as the litigation unfolds. “For now, the only question is what should happen as this case proceeds – who should bear the burden of the status quo,” attorneys for SFFA told the Supreme Court. “Every year this case languishes in discovery, trial, or appeals, West Point will label and sort thousands more applicants based on their skin color – including the class of 2028, which West Point will start choosing in earnest once the application deadline closes on January 31. Or should West Point bear the burden of temporarily complying with the Constitution’s command of racial equality?” they added in part.

☆ Retired conservative federal judge urges Supreme Court to disqualify Trump from office

CNN —A former conservative federal appellate judge is urging the Supreme Court to keep Donald Trump off the ballot, arguing the ex-president’s effort to cling to power after his 2020 election loss was “broader” than South Carolina’s secession from the US that triggered the Civil War. Trump tried to prevent the newly-elected President Biden from governing anywhere in the United States. “Trump incited, and therefore engaged in, an armed insurrection against the Constitution’s express and foundational mandates that require the peaceful transfer of executive power to a newly-elected President,” the brief said. The US Supreme Court agreed earlier this month to review the unprecedented decision from the Colorado Supreme Court that removed him from that state’s ballot. In a 4-3 ruling issued last month, the state court said Trump is constitutionally ineligible to run in 2024 because the 14th Amendment’s ban on insurrectionists holding office covers his conduct on January 6, 2021.

CNN —As Donald Trump wages a Supreme Court battle to stay on state presidential ballots, a potent contingent of the conservative legal world has united behind him. The new filings in the case of Trump v. Anderson also reinforce the tight world of Supreme Court lawyering. From the start, the Colorado voters trying to keep Trump off the ballot, and who won at the state Supreme Court level, have been represented by former US Supreme Court clerks who’ve become prominent advocates. CNN —Alabama is poised to carry out the first known execution using nitrogen gas Thursday to put Kenneth Smith to death for his role in a 1988 murder for hire. The state, in court records, indicated the redactions were made to maintain security. Smith’s team again Thursday morning appealed to the US Supreme Court and requested a stay of execution. “But the way that they’re constructing this, the way that they’re doing it, the way that they’re being silent, the way that they’re holding back information, yes, it’s incredibly concerning. Smith was convicted and sentenced to die, but an appeals court overturned the initial outcome and ordered a new trial.

CNN —Former President Donald Trump is urging the US Supreme Court to reverse the Colorado Supreme Court’s ruling that removed him from that state’s ballot. “The Court should reverse the Colorado decision because President Trump is not even subject to section 3, as the President is not an ‘officer of the United States’ under the Constitution. And even if President Trump were subject to section 3 he did not ‘engage in’ anything that qualifies as ‘insurrection,’” Trump’s attorneys argued. The US Supreme Court agreed earlier this month to hear the case, accepting an appeal brought by Trump. The Oregon Supreme Court dismissed a similar case last week, telling the anti-Trump challengers that they might be able to refile it later, based on what the US Supreme Court does in the Colorado case.

For nearly a quarter-century, Sandra Day O’Connor , who died Friday at age 93, was perhaps the most powerful woman in America, often casting the deciding vote when her Supreme Court colleagues divided 4-4 along ideological lines. Her decisions on issues including abortion, affirmative action, voting rights and the line between church and state often reflected a pragmatic middle ground that frequently aligned with mainstream public opinion. O’Connor’s retirement in 2006 sent the court in a new direction.
